What do you know about an ERISA Wrap Document?

ERISA (the federal Employee Retirement Income Security Act) requires employers to have an ERISA Wrap Document in place if they offer or sponsor benefits to their employees.  If employers don’t have this in place they may be liable for serious penalties and fines.

The Department of labor has increased its audit staff and national enforcement initiatives to investigate employers’ compliance with Health Care Reform.  This has resulted in companies of all sizes now being audited and being required to provide a SPD and Plan Document to their employees.

 

If you think your insurance contracts, certificates of insurance and benefit summaries fulfill the ERISA requirements…… I am here to tell you, THEY DON’T!  These insurance documents don’t include the required or recommended provisions that protect the plan and yourself, as the employer.  You need to have a customized Wrap SPD and Wrap Plan Document that provides the required ERISA provisions and information that will help you achieve compliance.  Penalties for non-compliance can add up fast.  The fine is $110.00/day per participant or beneficiary for each violation.
